HSR Rental Services Terms and Conditions

By renting equipment from HSR Rental Services, you (“Client”) agree to the following Terms and Conditions. Please read carefully.

 

1. Rental Period and Return of Equipment

- The rental period begins when the equipment is issued to the Client and ends on the agreed-upon return date.

- Equipment must be returned by the specified date and time. Late returns will incur a daily late fee of €10 per item, which will be charged until the equipment is returned.

- Late returns will be charged with the cost of one day rental fee for the rented item.

 

2. Reservations and Cancellations

- Reservations: Reservations are confirmed upon receipt of the receipt of an email from the rental office. Reservations must be made no later than one week before the rental period begins.

- Cancellations: Cancellations made 48 hours or more before the start of the rental period are eligible for a refund, minus a €10 administrative fee. No refunds will be given for cancellations made less than 48 hours in advance.

 

3. Liability for Lost or Damaged Equipment

- The Client is responsible for the full retail value of any equipment that is lost, stolen, or damaged beyond normal wear and tear.

- In the event of damage, the Client agrees to pay for repair costs. If the equipment is irreparably damaged, the Client agrees to pay the replacement cost as determined by HSR Rental Services.

 

4. Assumption of Risk

- The Client understands and acknowledges that skiing, snowboarding, and other snow sports carry inherent risks, including serious injury or death. The Client voluntarily assumes all risks associated with these activities and the use of rented equipment.

- The Client certifies they are in suitable physical condition to engage in these activities and understands that equipment failures may occur, particularly with binding systems, which may not release under all circumstances.

 

5. Health and Safety Requirements

- Helmet and Safety Gear: Helmets and additional protective equipment are highly recommended. Helmets and other safety gear may be rented upon request.

- The Client certifies that they are in good physical health and capable of participating in winter sports without endangering themselves or others.

 

6. Cleaning and Repair Charges

- Equipment must be returned clean and in good condition. Any cleaning required upon return will incur an additional fee of €10.

- Equipment inspection will occur upon return to identify any damages. The Client will be charged for repair costs if damages are identified, or for full replacement if deemed necessary by HSR Rental Services.

 

7. Waiver of Liability and Indemnification

- The Client waives, releases, and discharges HSR Rental Services, its employees, and affiliates from any and all claims, damages, or liabilities arising from the use of rented equipment.

- The Client agrees to indemnify and hold harmless HSR Rental Services from any claims, damages, or expenses, including attorney fees, related to the use of the rented equipment.

 

8. Use of Equipment

- Equipment rented from HSR Rental Services is to be used solely for its intended purpose in designated areas. The Client agrees not to use the equipment in extreme or hazardous areas unless expressly approved by HSR Rental Services.

- Any misuse of equipment that results in damage or injury is the sole responsibility of the Client.

 

9. Governing Law and Jurisdiction

- This agreement is governed by the laws of Romania. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in Timis.

 

10. Agreement and Acknowledgment

- By renting equipment from HSR Rental Services, the Client acknowledges they have read, understood, and agree to all the Terms and Conditions outlined in this document.

- The Client further agrees that this agreement constitutes the entire understanding between the parties and supersedes any prior agreements or representations.
